Program Details:

The last will and testament of a decedent pours over assets into a testamentary trust, which is identified and described in the last will and testament.  The panel of attorneys, with Judge Joyce as moderator, will discuss questions such as: what do lawyers do at the time of final settlement?  how is the testamentary trust set up upon final settlement of the probate estate?  is a separate petition filed and new case created?  If so, how is that done?  What are the reporting requirements to the court for the testamentary trustee, if any?  What happens when the testamentary trust is silent about the trustee’s duties, such as accounting for his/her actions?
